Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. O presente artigo analisa os sentidos abstratos para a soberania do povo como pressuposto para a fixação de sentidos concretos para a democracia participativa em um Estado de Direito. A temática é abordada pelo método dedutivo, por meio de pesquisa doutrinária e de diplomas normativos. O artigo pretende responder em que medida se afigura possível estabelecer bases de racionalidade para a construção de um discurso compatível com os direitos de participação política em um Estado Democrático de Direito.

John Locke's account of personal identity is one of his most discussed theories. Opposing the Cartesian ontology of mind, Locke argued that the soul does not always think - for thinking is simply one of its operations, but not its essence -, and that personal identity consists in consciousness alone. Against Locke, an anonymous commentator published the Remarks upon an Essay concerning Humane Understanding charging Locke's view with possible immorality. Catharine Cockburn rebuffed the Remarker's objections, in her Defence of Mr. (...) Locke's Essay, depicting his view as more dangerous for morality than Locke's. This paper shifts the focus from Cockburn's defence of Locke's moral thought, to her apology for his theory of personal identity, including his probabilistic arguments in favour of the immortality of the soul. This shift of focus yields an alternative account of Cockburn's originality: first, because she offered a non-substance interpretation of Locke's theory of personal identity, that, for its time, was unusual, and remains relevant for contemporary philosophical debates over Locke; and second, because, following Kristeller, in the very act of defending and articulating anew Locke's theory, Cockburn in some sense appropriated it. Receptor oligomerization plays a key role in maintaining genome stability and restricting protein mutagenesis. When properly folded, protein monomers assemble as oligomeric receptors and interact with environmental ligands. In a gene-centered view, the ligand specificity expressed by these receptors is assumed to be causally predetermined by the cell genome. However, this mechanism does not fully explain how differentiated cells have come to express specific receptor repertoires and which combinatorial codes have been explored to activate their associated signaling pathways. It is (...) our contention that the plasma membrane acts as the locus where several contextual cues may be integrated. As such it allows the semiotic selection of those receptor configurations that provide cells with the minimum essential requirements for agency. The occurrence of protein misfolding makes it impossible for receptor monomers to assemble along the membrane and to sustain meaningful relationships with environmental ligands. How could a cell lineage deal with these loss-of-function mutations during evolution and restrain gene redundancy accordingly? In this paper, we will be arguing that the easiest way for bacteria clones to accomplish this goal is by getting rid of cells expressing mutated receptor proteins. The mechanism sustaining this cell selection is also occurring in many somatic tissues and its function is currently believed to counteract in vivo protein mutagenesis. Our discussion will be mainly focused on the significance and semiotic nature of the interplay between membrane receptors and the epigenetic control of gene expression, as mediated by the control of mismatched repairing and protein folding mechanisms. The aim of this paper is to analyze a selection of arguments used by the Argentine Supreme Court to reduce the sentence of individuals convicted of crimes against humanity. The focus will be primarily centered on “Muiña´s case”, in which a lenient outdated ruling was made. The questions that this work will try to answer revolve around the court´s merit in issuing this lenient ruling to Muiña´s case and its justification. First, Muiña´s case is analyzed in depth. Then, a critical (...) analysis about the ruling and a decision concerning the existence of a true justification will be developed. Finally, we will discuss the appropriateness of the Court’s decision in Muiña´s case as opposed to the decision made in “Batalla´s case”, in which a less beneficial law was applied retroactively. In this paper, we critically analyze the mechanicist approach to scientific explanation and propose to complement this view with a conception of level as interval of quasi-decompositionality. This conception allows us to metaphysically base the mechanicist proposals on characteristic systemic features. By means of concrete examples, we claim that this proposal is able to overcome some of the alleged limitations of predominant models of mechanistic explanation.

Resumen En el presente trabajo analizo el concepto de cuerpo en los escritos maduros de Leibniz. En el marco del debate contemporáneo acerca del estatus de la sustancia corpórea examino el entramado de las tres nociones sobre las que se construye la metafísica leibniziana de los cuerpos, a saber, la de materia prima, la de cuerpo orgánico y la de extensión. En cada caso evalúo el estatus ontológico que Leibniz les reconoce así como el papel que cumplen en su metafísica.In (...) this paper I examine the concept of body in Leibniz’s mature writings. Resumen Este artículo analiza, en discusión con Joaquín García-Huidobro y Alejandro Miranda, la conveniencia de utilizar en moral sexual el argumento de la facultad pervertida, conforme al cual sería inmoral frustrar el fin natural de las facultades reproductivas. Según García-Huidobro y Miranda este argumento sólo puede utilizarse desde el “principio de totalidad”, pues su uso aislado llevaría a los absurdos denunciados por la New Natural Law Theory. Con vistas a una reconsideración de este argumento, se demuestra la importancia de considerar (...) la ética en su carácter tópico o contextual. Así, es en el ámbito de la templanza y de las inclinaciones sexuales donde el AFP cobra un papel normativo; en cambio, el “principio de totalidad” entra en juego cuando se está considerando el problema del límite de las intervenciones médicas.This paper focuses on the adequacy of using the so-called perverted faculty argument within the context of sexual morality. According to this argument, frustrating the reproductive faculty would be immoral. Professors García-Huidobro and Miranda think that this argument can be appropriately used only within the framework of the principle of totality. They argue that an unqualified use of the PFA would lead to the absurdities pointed out by the New Natural Law Theory. In order to see the PFA in a new light we demonstrate the importance of respecting the dialectical or contextual nature of Ethics. Thus, regarding temperance, and especially sexual inclinations, the PFA has a clear normative role. The principle of totality, instead, must be used when considering the problem of the moral limits of medical interventions. (shrink)

In the transforming world of cyber space, we ask whether we can bring into interplay our conscious and unconscious parts to dream and interpret the world of digital sociality and of seemingly total knowledge. We further ask whether we can build upon our deeply rooted mechanisms of resistance and rebellion to cultivate the growth of social and individual awareness of the danger of social fragmentation arising from the utopian fantasies of individualism and mobility, and thus confront the dilemmas of surveillance capitalism and autocratic automaton. The present work aims to study the knot formed between ontology, normativity and subjetivation in order to tackle the problem of materiality of domination relations. Along these lines, a materialist aproach will explore the movements, relationships and multiple implications among these dimensions. This method seeks to dismantle the tendency of philosophical idealism that appeals to the suture, blocking and closure of the plurality of events through some normative principle of a, let´s say, a priori trascendental or empirical character. Si en una fingida encuesta se planteara la cuestión más bien extraña, quizá un punto absurda ―como las de tantos otros sondeos de las opiniones de las gentes―, acerca de cuál es la obra que mejor expresa el derrotero histórico de la fenomenología en España a lo largo del siglo XX, yo al menos, sin pretender condicionar la dóxa de nadie, contestaría señalando no a una obra original sino a una peculiar traducción de Husserl al castellano. Dicha traducción, que iba (...) precedida de un largo estudio introductorio, se publicó incompleta, y, por si fuera poco, apareció además fuera de España: en México, en el año incierto de 1942. De una imprenta de la Ciudad de México salía al mundo en esa fecha, en efecto, la notable versión que José Gaos preparó de las Meditaciones cartesianas de Edmund Husserl. O mejor, salía a la luz su traducción de las cuatro primeras meditaciones, pues la versión castellana de la meditación quinta desapareció bajo los escombros del piso madrileño en que la familia Gaos vivía antes de la guerra (calle de Marqués de Urquijo 15). Germ cells are cross-roads of development and evolution. They define the origin of every new generation and, at the same time, represent the biological end-product of any mature organism. Germ cells are endowed with the following capacities: to store a self-descriptive program, to accumulate a protein-synthesizing machinery, and to incorporate enough nourishment to sustain embryonic development. To accomplish this goal, germ cells do not simply unfold a pre-determined program or realize a sole instructive role. On the contrary, due to the (...) complexity of their cytoarchitecture and the nature of the soma-to-germ interactions, they are heavily involved in processes of sign recognition and meaningful tissue exploration. At each stage of their inward migration, germ plasma membranes act as semiotic interfaces allowing cells to interact with the surrounding extracellular milieu and experience the compatibility of selected developmental sequences. The question of which signaling pathways are activated at each developmental stage does not result from a strictly predetermined program instructing germ cell stemness. Rather, each developmental sequence is an open-ended semiotic relationship explored and gradually defined during evolution by the context-dependency of specific cell-to-cell interactions. In this way, any structural and functional novelty that has emerged in the course of germ cell interactions may be interpreted as an exaptation fixed in the species genome in response to specific environmental constraints. The egg behaves as a prospective cell sustaining the developmental processes of the future embryo. In biosemiotic terms, this apparent teleonomic behaviour can be accounted for without referring to the exclusive causal role played by its genetic makeup. We envision two different processes that are uniquely found in the oocyte: (1) the first involves the mechanisms by which large amounts of mRNA accumulate in the ooplasm to establish the embryo axes prior to fertilization; (2) the second involves transfer of an (...) excess of maternally supplied ribosomes to the oocyte to provide the future embryo with newly synthesized proteins. In this paper, we argue that the information required to sustain embryonic development is not due to any physical properties of the zygotic DNA and the maternal mRNAs, but to their spatially and temporally ordered relationship in the zygote’s internal space. En este artículo se discuten las críticas de John Dupré contra la unidad metodológica de la ciencia. Como se sabe, a partir de la premisa del desorden de las cosas, Dupré rechaza tanto las versiones fuertes como las variantes débiles de unificación, pero construye sus mejores argumentos contra las últimas a partir de la tesis de que no hay una solución satisfactoria del problema de la demarcación. Tras exponer los argumentos de Dupré en favor de la implausibilidad de cualquier formulación (...) débil de la tesis de la unidad de la ciencia (incluyendo aquellas que se enfocan en la unidad metodológica), explicaré su formulación del problema de la demarcación, examinaré su caracterización de la teoría de la falsabilidad de Popper y responderé a sus argumentos en contra de la posición de Popper sobre la cientificidad. Mis argumentos mostrarán la inadecuación del tratamiento que da Dupré a este problema y señalarán una ruta para mostrar que la solución de Popper al problema de la demarcación, por medio del criterio de falsabilidad, permite defender una forma no reduccionista de la unidad de la ciencia. Studies demonstrating the benefits of ethical behavior at an individual level are scarce. The business ethics literature centers its analysis on unethical behaviors and their consequences, rather than ethical behaviors and their benefits. There is now considerable debate on the role of auditors in society and the function of accounting firms in the free market capitalist system. Specifically, the eminently ethical nature of the auditor’s work has been highlighted. Therefore, the aim of our paper is to show the impact of (...) auditors’ sustained ethical behavior: the trust it generates. This trust results in considerable benefits for the firm due to a reduction in the costs of the partner’s supervision of the auditor. The methodology chosen to validate these claims is a survey of partner of the audit firm in auditing companies. The results of this research confirm the hypotheses raised in the theoretical model. The aim of this work is to question the neoliberal governance standing from Michel Foucault’s philosophy. The starting point is that Foucaultian reflection is able to trigger a characterization of neoliberal rationality which can show the connection between freedom, individual and government. Likewise, the hypothesis of this writing holds that Foucault’s notion of ontology of actuality allows to criticize in a quite radical way the identities that the neoliberal logic imposes. From this point of view, it will be possible to (...) see the precise sense of ethical and political actions which, not disregarding the individual autonomy and the communal bond, are able to resist the regime of power, knowledge and subjectivity that neoliberalism attempts to impose. El presente escrito se propone reflexionar acerca del proceso de subjetivación en los últimos trabajos de Michel Foucault. Siguiendo sus precisiones de método, se buscará reconocer el nudo constituido por los dispositivos de poder y las técnicas de sí. La idea será mostrar la imbricación efectiva de nuestra subjetividad en procesos más generales de dominación. Es sabido que el gran acierto del neoliberalismo radica en articular nuestros placeres, prácticas y saberes más arraigados con formas abusivas de ejercicio del poder que (...) unos ejercen sobre otros. Ante esta situación, confío en que el método ofrecido por Foucault puede contribuir a descentrar esta posición subjetiva funcional a los sistemas de dominación y, al mismo tiempo, fortalecer un proceso de subjetivación pulido, razonado y realista capaz de evitar que la subjetividad se convierta en el cebo utilizado por diversas estrategias de dominio. This paper aims at providing an epistemic defense of democracy based on John Dewey’s idea that democracies do not only find problems and provide solutions to them but they also articulate problems. According to this view, when citizens inquire about collective issues, they also partially shape them. This view contrasts with the standard account of democracy’s epistemic defense, according to which democracy’s is good at tracking and finding solutions that are independent of political will-formation and decision-making. It is also less (...) vulnerable to the criticisms that have been raised against the standard account. To show this, the paper develops a theory of expressive domination and argues that problem-articulation works best when it is inclusive and domination-free. It also shows that democratic conflict represents a fundamental element for problem-articulation. (shrink)

Some transhumanist authors make the prophecy of immortality thanks to the transfer of the human mind to a superintelligent computer that would guarantee the survival of the person. That immortality would mean a happy life. In this article we try to show that this supposed indefinite survival is not exactly what is usually understood by immortality. In addition, we try to think about what immortality is based on the theological understanding of eternity and personal communion in which the life of (...) God consists. This article considers Edward W. Said’s proposals on ‘imaginative geographies’ as suggested in his leading work Orientalism as a tool to analyse the ideological circumstances that shape geographical spaces in the Bible. My purpose is to discuss how these imaginative geographies are present in the patriarchal narratives of Genesis and how they have left their mark on the history of the interpretation of these texts and on the not always easy relations between members of the religious traditions inherited from the (...) Bible (Hebrews, Muslims and Christians). I propose four types of ‘imaginative geographies’: (1) ‘Equalness’ is the way to represent what is considered as sharing the own identity. The geography of ‘Equalness’ defines the spaces of Isaac, Jacob and their families. (2) ‘Otherness’ is the way to represent the ‘Other’ as opposite or juxtaposed to one’s own identity. A common border is shared, thus kinship relationships can be established. It defines the spaces of Ishmael, Esau/Edom, Lot (Ammon and Moab) and Laban. (3) ‘Foreignness’ is the way to define what is strange, odd or exotic considered as external to the own identity, in a space set beyond even the space of the ‘Other’. Egypt is in Genesis a land of ‘Foreignness’. (4) ‘Delendness’ encompasses whatever claims our same space and therefore threatens our survival and must be destroyed ( delendum ). As such, processes of annihilation and dominion of Israel on Canaanites and Sichemites are justified. Contribution: The article applies Said’s ‘imaginative geographies’ as an identity mechanism for the creation of biblical literary spaces. A quadripartite classification (‘Equal’/‘Other’/‘Foreigner’/‘Delendum’) instead of the usual bipartite one (‘Equal’ vs. ‘Other’) is proposed and the consequences for the current coexistence between religious identities inherited from Abraham are shown. Stakeholder engagement and dialogue have a central role in defining the relations between organisations and their internal and external interlocutors. Drawing upon the analysis of dialogic motifs, power–conflict dynamics and sociopolitical perspectives, and based on a set of interviews with the stakeholders of a consumer-owned cooperative, the research explores the dialogic potential of stakeholder engagement. The analysis revealed a fragmented picture where the co-design and co-implementation aspects were mainly related to the non-business areas of cooperative life, while business logic dominated (...) the most central aspects. Stakeholder engagement was mainly related to consensus building, while dialogic engagement based on a pluralistic understanding was only partially considered and then neglected. The social capital in the local area, the growing size of the organisation and the related power structure embrace stakeholder engagement, influencing the orientation of the dialogic dynamic. The analysis indicates that a dialogic exchange is a relative concept which depends on the interests involved and the topics discussed. It also reveals that the key factors in the democratisation of stakeholder engagement are a mutual understanding and long-term opportunities. Common sociopolitical aspects are also important, but they do not necessarily guarantee the creation of dialogism paths. The research contributes to the critical dialogic literature in revealing whether and how stakeholder engagement has been implemented in a specific setting. It also shows the limitations of voluntarist stakeholder engagement initiatives. (shrink)
